GENERAL TERMS AND CONDITIONS

  1. Introductory Provisions

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") define the content of the contract concluded between Soós Bertalan e.v. (registered office: 1094 Budapest, Berzenczey Street 4-6, 4th floor 46/a; tax number: 66187969-2-43), as the service provider ("Provider") and the user of the commercial services provided by the Provider on the bertalansoos.com/shop ("Webshop") website ("Customer"), in addition to the provisions of mandatory applicable laws. Accordingly, it includes the rights and obligations of the Parties (Customer and Provider collectively referred to as the "Parties"), the conditions for the conclusion of the contract, the deadlines for performance, the terms of delivery and payment, liability rules, as well as the conditions for exercising the right of withdrawal. 

 1.2 By using the Webshop, the Customer accepts and acknowledges as binding the provisions contained in these General Terms and Conditions ("GTC"). Please only use our services if you agree to all of its points. If you have any questions regarding these General Terms and Conditions, the use of the website, individual products, or the process of purchasing, or if you would like to discuss your specific requirements with us, please contact us at the provided contact details. 

1.3 This document is not registered; it is concluded solely in electronic form (it does not constitute a written contract), and it does not refer to a code of conduct. If any part of the GTC is legally incomplete or invalid, the other provisions of the contract remain in force, and the relevant provisions of the applicable laws shall apply in place of the invalid or incorrect part.

1.4 Hungarian law shall apply to matters not regulated in these GTC, as well as to the interpretation of the GTC, with particular reference to Act V of 2013 on the Civil Code ("Civil Code") and Act CXXVIII of 2001 on certain issues of electronic commerce services and information society services. The mandatory provisions of the relevant laws shall apply to the Parties without any specific stipulation.

  1. Protection and Security of Personal Data

3.1 The website's privacy policy regulates the protection of personal data in detail. These provisions are mandatory for all Customers.

  1. Range of Products and Services Available for Purchase

4.1 The Webshop sells art products that can be ordered electronically. 

4.2 Two types of products are available in the Webshop based on the time of preparation: products already in stock before ordering and products to be prepared based on the Customer's order. The deadlines for performance and the right of withdrawal may vary depending on the type of product.

4.3 The data available in the Webshop is for informational purposes only. 

4.4 Prices are not listed alongside the products and services in the Webshop. The Customer can request a quote from the Provider via email at info@bertalansoos.com .

  1. Procedure for Placing, Processing, and Fulfilling Orders

5.1 You can place your order via email by providing details about the product and/or service, billing, and delivery-related information to this email address: info@bertalansoos.com 

5.2 The Provider is obliged to confirm the Customer's order to the Customer electronically without delay, but no later than within 2 business days. The order and its confirmation are considered received by the Provider or the Customer when it becomes accessible to them. Incorrectly provided email address or full inbox of the mailbox may result in non-delivery of the confirmation. 

5.3 The Provider can fulfill orders within 5 to 15 business days from the confirmation, depending on the nature of the selected product and the chosen payment method. For products already in stock, personal pickup can be arranged on the same day as the order, while the processing time for elaborated images (e.g., mounting, framing) extends the fulfillment time. In the case of payment by credit card, fulfillment begins on the day the payment is received on the Provider's bank account, while for cash payments, it begins on the day of order confirmation. The Provider always strives to adhere to the expected fulfillment deadline; however, it is not responsible if the above-mentioned usual or indicated fulfillment time cannot be met. In case of any delay, the Provider endeavors to inform the Customer.

5.4 Expected preparation times for individual product types are as follows:

  • Products in stock and postcards: immediate
  • Premium paper prints: 5-6 business days
  • Acrylic images, canvas images, and images mounted on aluminum sheets: 6-12 business days
  • Framed images: 8-15 business days

5.5 If the Provider is unable to fulfill its contractual obligation for any reason, it is obliged to inform the Customer immediately and refund the amount paid by the Customer without delay, but no later than within thirty days. 

  1. Correction of Input Errors - Responsibility for the Accuracy of Provided Data

6.1 The Customer is responsible for the accuracy, validity, and authenticity of the data provided when ordering products and/or services.

6.2 By placing an order, the Customer acknowledges that the Provider is entitled to charge the Customer for any damage and costs arising from inaccurately provided data. The Customer is not liable for inaccurately provided data only for the performance based on such inaccurate data.

  1. Payment Options

7.1 The Customer can pay for the product price by bank transfer or in cash.

7.2 Bank transfer: upon receipt of the electronic invoice. Fulfillment begins on the day the transfer is received on the Provider's bank account.

7.3 Cash payment: available for orders not exceeding 80,000 HUF and for personal pickup.

  1. Delivery and Personal Pickup

8.1 The details and cost of home delivery are agreed upon by the Parties during the ordering process.

8.2 The price of the product does not include the cost of home delivery and the packaging required for it.

8.3 Delivery is not available for the following product types and delivery destinations:

  • delivery of framed images outside Hungary
  1. Right of Withdrawal

9.1 Pursuant to Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, the Customer may withdraw from the contract without justification within 14 days of receiving the ordered product and return the ordered product, except if the product has been produced according to the Customer's wishes or personalized instructions, and it can be presumed that it was made exclusively for the Customer and has value to the Customer, in which case the Provider is not obliged to take back the product.  

9.2 If the consumer wishes to exercise their right of withdrawal as detailed in section 9.1, they must notify the Provider immediately, but no later than within 14 days, by email or phone, and arrange for the return of the product to the Provider. The Customer is responsible for any decrease in value resulting from the use of the product beyond what is necessary to establish the nature, characteristics, and functioning of the product, and must reimburse the Provider accordingly.

9.3 In the case of a contract for the purchase of goods, the business may withhold the amount to be refunded to the consumer until the consumer returns the goods to the Provider or provides conclusive evidence to the Provider that they have returned the goods. 

  1. Warranty

10.1 The Provider's warranty and liability are governed by the provisions of the Civil Code. 

  1. Complaint Handling

11.1 The Customer may communicate any complaints regarding the operation of the Webshop, product sales, or any issues related to products and/or services orally or in writing to one of the Provider's contact details. 

11.2 The Provider is obliged to investigate the Customer's complaint and, if necessary, remedy it.

11.3 The Provider and the Customer shall attempt to settle their disputes amicably. For disputes falling under the scope of these Regulations that cannot be settled by agreement, the parties may refer to the following bodies: consumer protection authority, competent conciliation bodies, court.

  1. Other Provisions, Information

12.1 Pursuant to Section 1 (1) of Act LXXVI of 1999 on Copyright (hereinafter: Copyright Act), the website is considered a copyrighted work, and therefore, all parts of it are protected by copyright. Pursuant to Section 16 (1) of the Copyright Act, it is prohibited to use graphic and software solutions found on the website, computer program developments without permission, or any application that can modify the website or any of its parts. Any material taken from the website and its database may only be used with the written consent of the copyright owner, with reference to the website and indicating the source. Images on the website are protected by copyright.
